Understanding Tree Preservation Orders (TPOs) & Conservation Areas — What Suffolk Homeowners Should Know

Trees add beauty, heritage and ecological value to many Suffolk and Newmarket gardens. Because of this, some are legally protected — either through a Tree Preservation Order (TPO) or by being located within a Conservation Area.

What Is a Tree Preservation Order (TPO)?

TPO is a legal order made by the local council (e.g., West Suffolk Council) to protect a specific tree, a group of trees, or a whole woodland.
It is usually applied to trees with:

  • High visual or historic value

  • Ecological importance

  • Landscape significance within the community

If a tree has a TPO, you must get written permission from the council before doing any of the following:

  • Pruning

  • Crown reduction

  • Limb removal

  • Pollarding

  • Root cutting

  • Tree felling

  • Any work that may harm the tree

Carrying out tree work without permission can result in fines up to £20,000 per offence — more in severe cases where prosecution moves to Crown Court.


How to Check Whether Your Tree Has a TPO

You can:

  1. Use your local council’s online TPO map (if available), or

What About Conservation Areas?

Large parts of Suffolk’s villages and historic towns — including areas around Newmarket — fall within Conservation Areas.

In a Conservation Area, ALL trees over 75mm diameter at 1.5m height are protected, even without an individual TPO.

This means you must give the council 6 weeks’ written notice before carrying out any tree work.

This notice period allows the council to:

  • Assess the tree

  • Decide if it deserves a TPO

  • Approve or refuse the work

You do not need formal permission afterward unless the council imposes a TPO — but you must wait for the 6-week period to expire unless approval is granted sooner.


What You Can Do Without Permission

There are a few exceptions, but they must be carefully documented. You may proceed without approval if:

  • The tree is dead

  • The tree is dangerous (posing immediate risk)

  • You are removing deadwood only

  • The tree is a hedge (in some cases)

  • The diameter is below 75mm in a conservation area

However — you must keep evidence (photos, arborist report) to prove the condition. Councils can still prosecute if they believe unnecessary or excessive work was done.
